1Introduction & Scope
This policy governs the sale, delivery, licensing and support of Digital Products on HmperCo.
2Legal Framework
- Electronic Communications and Transactions Act 25 of 2002 ("ECTA") — section 42(2) excludes goods or services which, by their nature, cannot be returned once supplied electronically (such as accessed digital content) from the general cooling-off right, which informs clause 6 of this policy.
- Copyright Act 98 of 1978 — governs the licence you receive to use a Digital Product; you do not acquire ownership of the underlying copyright.
- Consumer Protection Act 68 of 2008 ("CPA") — continues to apply to your right to a Digital Product that is not defective and matches its description.
3Digital Delivery & Access
Digital Products are delivered electronically to your registered email or Account, typically as a download link, access code, or activation credential, immediately or shortly after successful payment.
4Licence & Permitted Use
Purchasing a Digital Product grants you a personal, non-exclusive, non-transferable licence to use it for its intended purpose. You do not acquire ownership of the underlying intellectual property, which remains with HmperCo or the relevant rights holder.
5Compatibility & Technical Requirements
You are responsible for ensuring your device meets any technical requirements stated on the Product listing before purchase. HmperCo is not liable for a Digital Product's incompatibility with a device or software not meeting the stated requirements.
6Refunds, Returns & Cancellation
Consistent with the customised/digital-goods exclusion under ECTA section 42(2) and clause 7.2 of the Returns Policy, Digital Products that have been accessed, downloaded, or activated may not be returned for a changed-mind refund. You may cancel an Order for a Digital Product before it has been delivered/accessed for a full refund.
7Unauthorised Copying & Digital Fraud
You must not copy, redistribute, resell, or share access credentials for a Digital Product beyond the licence granted to you. Suspected unauthorised distribution or digital fraud (for example, chargeback fraud on digital purchases, which are especially vulnerable given instant delivery) is handled under the Fraud, Abuse, Account Security & Responsible Disclosure Policy.
8Defective Digital Products
If a Digital Product is defective (for example, a broken download link or a non-functional code), report it to thankyou@hmperco.co.za; HmperCo will provide a working replacement or a full refund, at no cost to you.
9Support
Support for accessing or using a Digital Product is available via info@hmperco.co.za.
