Vouchers, Coupons & Gift Vouchers Policy

1Introduction & Scope

1.1 This policy governs all Vouchers, gift vouchers, discount vouchers, promotional codes and coupon codes issued, sold, or accepted on the HmperCo Platform ("Vouchers"), for all customer types, including Stokvel and Split & Sell ("SnS") customers.

2Legal Framework

• Consumer Protection Act 68 of 2008 ("CPA") — section 63 regulates customer loyalty programmes and pre-paid certificates such as gift vouchers, including requirements around clear disclosure of terms, expiry, and fair dealing.
• Electronic Communications and Transactions Act 25 of 2002 ("ECTA") — governs the validity of electronic Vouchers and codes as electronic records and transactions.
• Financial Intelligence Centre Act 38 of 2001 ("FICA") — HmperCo applies reasonable anti-money-laundering and fraud-prevention diligence to high-value Voucher purchases and redemptions, consistent with its obligations as a reporting entity where applicable.
• Protection of Personal Information Act 4 of 2013 ("POPIA") — governs personal information collected in connection with Voucher purchase, gifting, and redemption.
• Prevention of Organised Crime Act 121 of 1998 ("POCA") — HmperCo will report and act on Vouchers reasonably suspected of being used to launder proceeds of unlawful activity.

3Types of Vouchers

4Issuance, Activation & Validity

1. Vouchers are issued electronically to the purchaser's or recipient's registered email, mobile number, or Account, and are activated automatically on issue unless the specific Voucher states otherwise.
2. Each Voucher carries a stated validity period, shown at the time of issue and in your Account. Unless a specific Voucher states a different period, gift vouchers are valid for 12 months from the date of issue, and promotional/discount vouchers are valid for the shorter period stated in the applicable promotion.
3. Expired Vouchers are not honoured, redeemable, or extended, save where required by law or at HmperCo's sole discretion in individual cases.

5Redemption Rules

1. Enter the Voucher code at checkout; the discount or balance is applied and reflected in your Order total before payment.
2. Where a Voucher's value exceeds your Order total, the remaining balance stays on the Voucher for future use (for gift vouchers and store credit) unless the specific Voucher states it is single-use only.
3. Where a Voucher's value is less than your Order total, you pay the difference via another accepted payment method.
4. Multiple Vouchers may be applied to a single Order only where the Platform interface permits "stacking"; unless expressly permitted, one promotional/discount code applies per Order.

6Restrictions, Exclusions & Stacking

6.1 Specific Vouchers may carry a minimum spend, be restricted to particular Products or categories, exclude delivery fees, or be limited to specified customer types (for example, new customers only, or SnS members only). These restrictions are disclosed at the time of issue.

6.2 Unless expressly stated otherwise, Vouchers cannot be combined with other promotional discounts on the same Order.

7Lost, Stolen & Compromised Vouchers

7.1 Treat your Voucher code like cash. HmperCo is not liable for a Voucher redeemed by a third party using a code you did not keep secure, save where the compromise resulted from HmperCo's own security failure.

7.2 If you believe a Voucher has been lost, stolen, or its code compromised before redemption, report it immediately to info@hmperco.co.za with your proof of purchase; HmperCo will investigate and may, at its discretion, cancel the compromised Voucher and issue a replacement where fraud by a third party (not you) is established.

8Non-Transferability, No Cash Value & No Resale

8.1 Unless a specific Voucher expressly states otherwise, Vouchers: are not redeemable for cash or cash equivalent, whether in full or in part; may not be resold, transferred for commercial gain, or used for any reseller or commercial purpose (including on the SnS programme); and remain HmperCo's property until redeemed, meaning HmperCo may cancel a Voucher found to have been obtained fraudulently or issued in error.

8.2 Attempting to resell, launder, or commercially trade Vouchers is a material breach of these Terms and may result in Voucher cancellation and Account action under clause 12.

9Vouchers & Returns

9.1 Where an Order paid for wholly or partly using a Voucher is returned under the Returns Policy, the Voucher-funded portion of the refund is returned to the original Voucher (or an equivalent replacement Voucher/store credit) rather than to a card or bank account, unless the original payment method also contributed to that portion.

9.2 Where a promotional discount reduced the price of a now-returned item, the discount is not separately refunded — only the amount actually paid for that item is refunded.

10Technical Errors, Duplicates & Invalid Vouchers

Where a technical error results in a Voucher being issued in duplicate, issued with an incorrect value, or issued in error, HmperCo may correct, cancel, or adjust the Voucher, and will notify you where this affects a Voucher already in your possession. Where you have already redeemed value from an erroneously issued Voucher in good faith, HmperCo will act reasonably and will not seek repayment from you for HmperCo's own error, save in cases of obvious abuse.

11Promotional Voucher Withdrawal

HmperCo may withdraw or amend a promotional voucher campaign at any time before use, save that a Voucher already validly issued to you and within its stated validity period will continue to be honoured according to its original terms, consistent with fair-dealing requirements under the CPA.

12Fraud & Account Restrictions

Where HmperCo reasonably suspects Voucher fraud — including fabricated Vouchers, exploited technical bugs, multiple-account abuse to claim promotional Vouchers repeatedly, or resale of Vouchers — HmperCo may cancel the relevant Voucher(s), reverse associated Orders, and suspend the Account(s) involved in accordance with the Fraud, Abuse, Account Security & Responsible Disclosure Policy.
