Create Your Own Hamper Terms

1Introduction & Scope

Create Your Own Hamper allows you to personally select and build a Hamper from available Products, priced by weight and/or item count, and to pay for it as a single Order or via a HmperCo instalment plan as described in clause 5.

2Legal Framework

• Consumer Protection Act 68 of 2008 ("CPA") — governs fair pricing disclosure and your rights in respect of defective or incorrectly fulfilled builds.
• Electronic Communications and Transactions Act 25 of 2002 ("ECTA") — because a CYOH build is made to your specification, it falls within the customised-goods exclusion from the general cooling-off right (section 42(2)), as explained in clause 9.
• Foodstuffs, Cosmetics and Disinfectants Act 54 of 1972 — governs food items you may include in your build.

3Building Your Hamper

Use the CYOH builder to add Products individually; the running total updates live as you add or remove items, showing the current price, weight (for weight-based items), and item count.

4Pricing, Weight & Quantity

4.1 Weight-based Products (for example, bulk foodstuffs) are priced per kilogram or the unit displayed; item-based Products are priced per item.

4.2 Final pricing is confirmed at checkout and may differ slightly from the builder estimate for weight-based items where actual packed weight varies naturally, consistent with the Food, Meat, Fresh Produce & Perishables Policy.

5Payment Plans: 3, 6 & 11 Month Options

5.1 You may pay for a CYOH build as a single upfront Order, or select an instalment plan (3-month, 6-month, or 11-month, where offered) under which you make scheduled payments toward the build before fulfilment and delivery.

5.2 Where a CYOH build is funded via the Stokvel programme, the Stokvel Legal Framework governs the contribution and cancellation process instead of clause 8 of this policy.

6Substitutions & Availability

If a Product you selected becomes unavailable before fulfilment, HmperCo will contact you to select a substitute of similar value and type, or to receive a refund/credit for that item, consistent with clause 5.3 of the Master Terms.

7Delivery

Delivery of your completed CYOH build is subject to the Delivery & Logistics Policy, including cold-chain handling for any perishable items included.

8Cancellation & Payment Failure

8.1 You may cancel a CYOH instalment plan before fulfilment by contacting info@hmperco.co.za; contributions paid to date, less any non-recoverable costs already incurred by HmperCo for perishable or reserved stock, will be refunded within 21 business days.

8.2 Where a scheduled instalment payment fails, HmperCo will notify you and provide a reasonable opportunity to remedy payment before placing the plan on hold.

9Returns & Perishables

Because a CYOH build is assembled to your personal specification, changed-mind returns under clause 4 of the Returns Policy do not apply to a correctly fulfilled build; however, defective, damaged, incorrect, or unsafe items within the build remain fully covered by the Returns Policy and the Food, Meat, Fresh Produce & Perishables Policy.

10Product Exclusions

Certain Products may be excluded from the CYOH builder where not suitable for personalised bulk selection (for example, age-restricted items); exclusions are indicated within the builder interface.

11Relationship to Stokvel & SnS

Create Your Own Hamper is a separate programme from Stokvel and Split & Sell. Where you use Stokvel funds or an SnS account in connection with a CYOH build, both this policy and the relevant programme terms apply, and, in the event of conflict on payment/cancellation matters, the programme-specific terms (Stokvel or SnS) prevail for those matters.
